(Los Angeles, CA) -- A California state appeals court will hear Roman Polanski's request to have his 1978 guilty plea to having unlawful sex with a 13 year-old girl thrown out, on the grounds of alleged misconduct by the original Los Angeles trial judge in the case. Earlier this year, a Los Angeles Superior Court judge threw out the request, saying he could not hear the motion if Polanski refused to appear in a Los Angeles courtroom for the hearing. Now, the Second District Court of Appeal in Los Angeles has agreed to hold a December 10th hearing on Polanski's appeal of that decision. The hearing starts at 10:00 a.m.
